Meeting Summary

June 7, 2018

In its June 7, 2018 meeting the Utah State Board of Education:

  *   Agreed to seek a one-year exemption from the achievement indicator calculation provision in the federal Every Student Succeeds Act while the state seeks a means to meet both federal requirements and honor Utah law which allows parents to opt their students out of statewide tests.
  *   Approved a new hybrid statewide test for high school freshmen and sophomores named Utah Aspire Plus and reviewed the new grades 3-8 statewide test, which has been named RISE.
  *   Agreed to begin creating a statewide school safety plan that will still allow district and charter schools flexibility to meet unique safety needs based on location and school construction.

Utah seeks one-year exemption on ESSA provision on non-tested students

The Utah State Board of Education will seek a one-year exemption<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AZGAQL6FC208> to the federal Every Student Succeeds Act (ESSA)<https://www.ed.gov/essa?src=rn> provision that requires states to include non-tested students as non-proficient in the calculation of the achievement indicator for a school when the assessment participation rate of a school falls below 95 percent.

Utah law<https://le.utah.gov/xcode/Title53G/Chapter6/53G-6-S803.html?v=C53G-6-S803_2018012420180124> allows parents and guardians to opt their children out of statewide testing and some schools in the state no longer meet the 95 percent participating requirement for school achievement calculations. Utah sought a waiver<https://www.boarddocs.com/ut/usbe/Board.nsf/files/AZGASE700C03/$file/Utah%20Waiver%20Request.pdf> to the achievement indicator calculation provision but that was denied<https://www.boarddocs.com/ut/usbe/Board.nsf/files/AZGASJ700D5D/$file/USED%20Waiver%20Denial%20Letter.pdf> by the U.S. Department of Education.

Utah is one of four states still awaiting approval of its ESSA plan<https://schools.utah.gov/file/ca295c05-cb18-4cf6-aefb-239c450d1c43>. ESSA is the primary federal regulation on public education and is the driving force behind about $100 million in funding for Utah public schools.

State Superintendent of Public Instruction Sydnee Dickson said it was her intent to have the request presented to the department next week.

Board approves new statewide hybrid test for grades 9-10;
grades 3-8 statewide test renamed RISE

The Utah State Board of Education approved<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AZ38K26FCB23> a contract with Pearson to provide a hybrid test comprised of Utah standards questions and ACT Aspire test questions for Utah public school students in grades 9-10. The new test will be called Utah Aspire Plus.

The Board also reviewed a communication plan<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AZG8XQ6BC886> for the grades 3-8 state test, which has been named RISE (Readiness. Improvement. Success. Empowerment). This test is being created by Questar using questions from Utah's assessment item bank.

New tests were necessary following this year's expiration of a contract with former test provider American Institute of Research (AIR) and a 2017 legislative change that requires separate assessments for grades 3-8 and grades 9-10.

Board seeks input on statewide school safety plan

The Utah State Board of Education will move forward on gathering information with an eye on creating a statewide school safety plan<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AZ3R2R5E3D3E> that still allows flexibility for district and charter schools to meet local safety and security needs.

Computer Science Taskforce recommends elementary start

The Utah State Board of Education's Computer Science Taskforce recommended<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AZ3R9D5EA5EC> the state develop a statewide computer science education framework emphasizing that each student in secondary public schools have access to robust and varied computer science courses. But the recommendations also note that it must begin in elementary schools with competencies in keyboarding, appropriate and responsible use of technology and basic coding principles.

Board approves nine rule amendments; repeals two rules

The Utah State Board of Education gave final approval to the following administrative rule amendments:

  *   R277-481 Charter School Oversight, Monitoring, and Appeals<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AYZ42W75F5F6>. This rule was amended for technical changes.
  *   R277-525 Special Educator Stipend<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AYZ43875FDA7>. This rule was amended for technical changes.
  *   R277-617 Smart School Technology Program<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AYZ43J760638>. This rule was amended for technical changes.
  *   R277-411 School District Sponsored School Seminars on Youth Protection-Related Issues<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AYZ43S760C50>. This rule is being repealed since it was a one-time program and deadlines for the program have now all passed.

  *   R277-463 Class Size Average and Pupil-Teacher Ratio Reporting<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AYZ44P762627>. This rule was amended for technical changes.
  *   R277-403 Student Reading Proficiency and Notice to Parents<http://www.boarddocs.com/ut/usbe/Board.nsf/goto?open&id=AYZ463764776>. This rule is being repealed and will be added to R277-406 K-3 Reading Improvement Program and the State Reading Goal.

2019 Board meeting dates set

The Utah State Board of Education voted to move its committee meetings, study sessions, and meetings as the Utah Schools for the Deaf and the Blind governing board to Thursdays evenings in 2019 and full Board meetings to Fridays.

Except for January and July, Board committee meetings will be held on the first Thursday of the month beginning at 3 p.m. and ending at 9 p.m. Again, except for January and July, Board meetings will be held on the first Friday following the first Thursday of the month beginning at 8 a.m. Committee motions from Thursday will be held the following month.

In January the Board will meet in committees on January 9 and as a full Board on January 10. The full Board will meet if needed on July 11 to attend to any necessary business at the beginning of the new fiscal year.

The Board will also hold legislative meetings on January 31, and on Thursdays between February 14 and February 28.
